    2. Not Official Test Provider

    Important: Speakonaut is an independent educational platform and is NOT affiliated with, endorsed by, or connected to:

    • IELTS™ (International English Language Testing System)
    • British Council
    • IDP Education
    • Cambridge Assessment English
    • Pearson PTE™ (Pearson Test of English)

    Our practice materials are designed to help you prepare for these tests but do not guarantee specific results. IELTS™ and PTE™ are registered trademarks of their respective owners.

    3. AI-Powered Feedback

    3.1 Nature of AI Assessment

    Speakonaut uses artificial intelligence (AI) technology to provide automated feedback on speaking and writing tasks. You acknowledge and agree that:

    • AI feedback is algorithmic and may not perfectly match human examiner assessments
    • Band scores and predictions are estimates based on assessment criteria
    • AI technology continuously learns and improves, which may result in variations over time
    • Final exam results depend on official test conditions and human examiners

    3.2 AI Data Processing

    When you submit audio recordings or written responses, our AI models process this data to generate feedback. This processing occurs on secure servers and complies with Australian privacy laws. Your submissions may be used to improve our AI models, but personal identifying information is removed during this process.

    4.1 Information We Collect

    Under the Australian Privacy Act 1988, we collect and store the following data:

    • Account Information: Email address, name, password (encrypted)
    • Practice Data: Test responses, audio recordings, written submissions, scores, and progress metrics
    • Usage Data: Login times, features accessed, device information, IP addresses
    • Payment Information: Billing details processed through Stripe (we do not store credit card details)

    4.2 Data Storage Location

    Your data is stored on secure cloud servers. While our service provider maintains servers internationally, we comply with Australian Privacy Principles (APPs) regarding overseas data transfers. Data is encrypted both in transit and at rest.

    4.3 Data Retention

    We retain your data for as long as your account is active and for up to 2 years after account deletion to comply with legal obligations and improve our services. You may request earlier deletion by contacting our support team.

    9. User Content and Intellectual Property

    When you submit content (recordings, written responses):

    • You retain ownership of your content
    • You grant us a license to use it for providing services and improving our platform
    • You represent that you have the right to submit the content
    • We reserve the right to remove content that violates our terms

    All practice materials, templates, and platform features are protected by copyright and remain our intellectual property.

    11. Australian Consumer Law

    Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your subscription and obtain a refund.
